Over Rule Nine states, including New York, New Jersey and Connecticut, sued the Environmental Protection Agency yesterday over a federal ruling governing mercury and other pollutants produced by cement plants. The lawsuit, filed in the United States Court of Appeals for the District of Columbia Circuit, says the latest rule by the E.P.A. would not require cement plants to lower emissions and violates the federal Clean Air Act. Cuomo, the New York State attorney general, said the lawsuit seeks to “compel the E.P.A. to follow the law and establish limits for the most dangerous pollutants.” The E.P.A. said yesterday that it would review the matter. The changes include the removal of two of the three previously approved indications -- acute bacterial sinusitis and acute bacterial exacerbations of chronic bronchitis -- from the drug's label. The agency has determined that the balance of benefits and risks no longer support approval of the drug for these indications. Ketek will remain on the market for the treatment of community acquired pneumonia of mild to moderate severity (acquired outside of hospitals or long-term care facilities). In addition, the agency has worked with the company, Sanofi Aventis, to update the product labeling with a "boxed warning," FDA's strongest form of warning. The warning states that Ketek is contraindicated (should not be used) in patients with myasthenia gravis, a disease that causes muscle weakness. Behaviors associated with impulse control—including compulsive shopping, hypersexuality, binge eating and pathological gambling—have been associated with dopamine agonists, medications used to treat Parkinson's disease. In studies examining the relationship between dopamine agonists and compulsive gambling, the likelihood of gambling problems was unrelated to the medication dosage. This suggests that an underlying trait may interact with the drugs and make an individual more vulnerable to this adverse effect.
